Will Retail Chains Lose Their Dominance?

In most industrialised nations the the supply chain of goods from source to end user has changed little for many years. Firstly there are the producers. Then the wholesaler, then the retailer and then the customer and consumer.

In the U.S. the supply chain has always been pulled by downstream consumers. Europe had a different history where a mixture of world wars and interventionist governments led to supply chains that were pushed from the upstream end. Certainly, the rationing of the 1940's and beyond led to a culture of consumers who got what they were given and were thankful for small mercies.

As Europe has become more affluent, consumers have flexed their muscles and demanded an ever wider array of goods at a range of prices and standards. It has now joined the U.S. and most other industrialised nations with consumer-led supply chains.

A feature of this has been the trend towards large retail chains. Many of these chains have become so large that they have virtually dispensed with wholesalers, preferring instead to purchase goods directly from producers. They have also established the so called "own brand". This is where they have dictated the product specification to the producer and told them to brand it as their own product. And there is more: some of the largest chains have increasingly got themselves involved with all aspects of the supply chain from raw material sourcing, packaging procurement and design, all aspects of distribution and even their suppliers' recruitment policies.

This has resulted in a shift in the balance of power from upstream to downstream. Now that every aspect of the producer's business, including their all important costs, have been tied down by the ever inquisitive retail chain, has the pendulum swung as far as it could? We all know what happens to pendulums when they have gone as far as they can in one direction. Now, I cannot surely be the only person who has thought about this. I am sure that directors of some of the large producers out there must have thought to themselves "how did we let this happen?". Perhaps some of the smaller producers whose management can't even visit the washroom without permission from the retailer (it seems) are also thinking "enough is enough".

Just think of this: who has put the capital and risk into the very expensive plant that is needed in a production environment? Not the retailers. Who has the skilled staff including engineers and designers? Certainly not the retailers. Who has detailed product knowledge within their own spheres? Retail chains, by their very nature specialise in putting largely unskilled staff in large buildings with rows of shelving and a line of checkouts. They can only ever have a superficial knowledge stretching across the vast product ranges they sell.

I know I have painted a picture of poor downtrodden producers that have been conquered by those nasty retailers. Firstly the retailers are not nasty at all - they are just doing their job - so let's not blame them. And there will be many producers out there who rather like the status quo and don't want to rock the boat. OK, so they don't get the kinds of profit margins they would like, but they do get volume. Though in my opinion, the reason why many producers want to leave things as they are is that they are slaves, even if they don't realise it.

It's a kind of drug dependency, but with the drug being high volume sales and the drug pusher being the retail chain. It's a familiar pattern. The producer is forced to reduce costs by a retailer promising higher volume in return for a greater share of the margin, so the producer invests in larger production facilities, faster machinery and takes on more staff. This is fine until the producer realises that he is now dependent on the retailer. The producer is now in the position where he must be given volume orders in order to ammortise his costs. The retailer says: I can give you volume, but you must give us more margin. For some producers the moment of truth comes when they need to take a leap into a big new production facility in order to keep up with these demands. So, they take on a loan and expand the business. Now they need a constant fix of volume business, not only to keep the factory going, but in order for their business to avoid bankruptcy. Some producers who have converted to this high volume business have gone so far with it, and have partnered so closely with their master retailer that they simply see themselves as an extension to the retailer and will not contemplate change.

Others may feel differently. They may be run by more independently-minded bosses, or may have kept up sales to other outlets in order to keep some trade going that is outside the sphere of the retail chain. I am sure that some producers want to see that pendulum start to make its way back, even if it is just a little way. But what can they do? Well, things are changing out there, so opportunities may arise sooner than expected.

Firstly, there is safety in numbers. Just ask the unions, or a herd of wilderbeest. I can see alliances taking shape over the next few years between non-competing producers who, between them, can offer a full range of products to consumers. Why can't they open their own retail outlets? Remember, the billions made by today's retail chains will no longer need to be serviced, so prices will be very competitive and margin healthy.

Secondly, there is pressure on fuel supply and prices. There has been a recent blip that might fall off again, but most experts agree that the long term trend is that prices will rise. As fuel costs begin to impact margins and even product prices there will be pressure to retail goods as close to their source as possible. It may even make sense to sell goods directly from a producer's own shop. In the UK, local farmer's markets have taken a significant slice of business away from supermarkets. I am suggesting here that this principle could be extended to more local selling opportunities from producers and not just farmers.

Thirdly, there is an increasing trend - mainly driven by legislation - to re-use parts in products that are at the end of their life and to re-use packaging. This reverse distribution will benefit once again from having producers as close to consumers as possible and it may benefit further by cutting out the retailer altogether for the return of goods.

Finally of course, there is the internet - shopping on line. Not a cashier or a shopping trolley in sight. Yes, distribution infrastructure is still required, but remember that many bricks and mortar retailers have still not fully got to grips with the structures that are required to distribute internet sales. The internet gives producers a wonderful opportunity to change the order of things to their advantage and sell directly to end users.

What many large retail chains have done has been breathtaking and can only be admired. They took control of their supply chains and used their new influence and power to their advantage and therefore to the advantage of their shareholders. Just remember though, that retail chains consist of unremarkable buildings, staffed with unskilled labour and with low-tech plant. They do not produce goods (usually) and they do not own any brands apart from their own. Their main asset is customer goodwill with the large throughputs of customers visiting their sites. If this throughput is threatened by high fuel prices or because of alternative attractions, then these large buildings will become white elephants. If this ever happens, the decline could be swift and decisive, for those retailers are just as addicted to their customers as producers are to them.

Accelerated Examination for Patent Applications in China

The State Intellectual Property Office (SIPO) has introduced a fast track system for the examination procedure of patent applications in China.

The Administrative Measures (in Chinese), issued on 19 June 2012, will come into effect on 1 August 2012, allowing for prioritized examination of certain types of invention patents.

What type of application is eligible?

Important applications relating to energy conservation and environment protection, new generation information technology, biology, high end equipment manufacture, new materials, new energy automobiles Important applications promoting the development of green technologies, such as those relating to low carbon emission and conservation of resources; Applications for the same invention first filed in China and then in other countries or regions; and Other applications which materially affect national or public interests and require examination that is prioritized

A request for prioritized examination shall be made in electronic form, together with a 'Form of Request for Prioritized Examination of Invention Patent Application' that has been recognized and endorsed by a local SIPO branch of the relevant province, autonomous region or municipality.

The applicant is also required to submit search and examination reports, issued by the patent examination authority of another country or region, such as the UK Intellectual Property Office or European Patent Office. Alternatively, the applicant can submit a search report issued by a recognised and competent entity. However, it remains to be clarified as to what a 'recognised and competent entity' is.

Upon receipt of a prioritized examination request, SIPO will review the application and notify the applicants of the result. The grant of this examination is discretionary, and the number of examaintions is to be determined by the capacity of the examination division.

From the date of grant of the prioritized examination, SIPO will issue the first Examination Report within 30 working days, upon which the applicant is required to respond or correct any issues raised in the report within two months. SIPO is to bring the case to conclusion within one year from the date of grant of the examination request. However, if a response to the examination opinion is not received within two months of the first Examination Report, the prioritized status of the application will cease and examination of the application will resume to normal.

Where SIPO has signed a bilateral or multi-lateral agreement with a patent authority of a country that includes prioritized or accelerated procedures, such agreements are to take precedence before the above scheme. For example, SIPO has agreements with a number of countries (Japan, Korea, US, Germany, Russia) under the pilot Patent Prosecution Highway (PPH) scheme.

The prioritized examination scheme is set to provide eligible applications with acceleration of examination. If your patent application is granted prioritized examination, it is important to respond to the first Examination Report within the 2 month deadline in order to maintain its priority status.

Apart from China, accelerated examination is also available in other countries, such as the UK, and Europe, and also specifically for applications relating to green technologies.

A Cheap Alternative To Broadband?

Unfortunately I was unable to use email in my tests, due to a 'port' conflict with a spam filter that I was using. The standard advice on the OnSpeed site for such cases is to disable the offending program. Not a constructive approach - to say the least - so I hope that the relevant instructions will be changed soon.

More significantly, the problem persisted even when I switched off the OnSpeed application on my PC; in the end I had to remove the program to get the spam filter working again. I expect that this fault can be resolved, but clearly there are issues in this area that need to be addressed.

The software is easy to install, and is available for Mac as well as Windows PCs. On the whole the service is surprisingly good, and a lot cheaper than broadband. Unlike other 'speed-up' techniques that tweak your computer's settings but result in little noticeable improvement, OnSpeed really works.

I can recommend OnSpeed for dial-up users who can't justify the expense of broadband, or who are not located close enough to a suitable exchange. OnSpeed is also stated to be great for mobile or PDA users, as GPRS (wireless) speeds can be boosted by as much as 8 times. It even helps with broadband if you can only get a reduced service in your area.

Married, with children (or grandchildren).

• One-half (1/2) to your surviving spouse and one-half (1/2) to your children (and grandchildren, in some cases).

Married to second or subsequent spouse, with children from prior spouse, but no children from subsequent spouse.

• Your surviving spouse receives the equivalent of 25% of the fair market value of your real estate, minus the value of any liens or mortgages against the real estate.

Bear in mind, these are general rules and far from a complete schedule of rules of intestacy. Furthermore, there are other rules that may affect the ultimate distribution of your probate assets, such as rules concerning personal property and family allowances.

How to Block Spam on WordPress

Spam is the scourge of the internet. No one wants to have spam comments filling up their WordPress website. It reflects poorly on you as a site owner, and this is especially true if you WordPress site represents your business!

Fortunately there are some great tools available to make eradicating spam on your WordPress site a piece of cake.

Akismet

The easiest way to deal with over 99% of your spam is to use the single most downloaded WordPress plugin, Akismet. (It comes bundled with the core WordPress software.)

Once you activate Akismet you will have to enter your WordPress API key. There are a couple way to get one.

If you have an account at WordPress.com then you already have one. (If you don't you can sign up for free.) Simply go to your WordPress.com "Profile Personal Settings" and you'll see your API key near the top of the page.

Copy that string of letters and numbers and paste them into the Plugins --> Akismet Settings on the dashboard of your own site. Then click the "Update Options" button and you'll be set.

Then Akismet will automatically compare every comment to their database. The ones it calculates are spam will go to a spam moderation folder on your dashboard and your site visitors will never see them. For the occasional spam comment that gets through you can just click the red "Spam" link under that comment in your comments list and it will pull it back from your site.

It's a good idea to scan through all the comments that get marked as spam periodically because it will also occasionally mark a legitimate comment as spam. When it does, just click the yellow "Not Spam" link and the comment will be move to your moderation folder where you can approve it so it shows up on the front page of your WordPress site.

A couple things about the way Akismet works. The filter learns from every single WordPress site owner. By marking spam comments as "spam" or "not spam", you are "training" Akismet - and not just for your site, but for every WordPress site that's using Akismet.

Because that's the case, it's a good idea to be judicious with marking comments as spam. When you do you are affecting that commenter across every WordPress site. Using that power vindictively could very well come back to haunt you. I'm just saying.

Defensio

A strong Akismet competitor in my mind is Defensio. Defensio actually does more than just protect your site from spam. It also can filter out profanity and keep out links to malware by blocking links to executable files and scripts.

I was an early tester for Defensio and I have to say I like the service. The way spam is presented makes it a little faster to double check for good comments trapped by mistake. I switch between Akismet and Defensio on my sites and both do a great job.

Like Akismet you will also need to get an API key to use Defensio on your site. You get one by signing up on their website.

One note: You don't want to run Akismet and Defensio at the same time. Deactivate one before you activate the other so they don't conflict with one another and cause problems with your site.

Bad Behavior

Another line of defense against spam on your WordPress site is Bad Behavior.

Bad Behavior is designed to use along side other spam filters such as Akismet or Defensio and works differently. Instead of filtering spam comments once they are entered into your website, Bad Behavior targets the methods by which spam is delivered.

If you still feel overwhelmed by dealing with your spam with one of the other plugins, you can add Bad Behavior and dramatically reduce the number of spam comments you ever even see on your site. Bad Behavior will block most spammer from even being able to access your site.

Simply install the plugin, activate it, and your WordPress site is doubly protected!
